NOTICE TO MEMBERS OF PRSI
Phil von Kahle was appointed Receiver for PRSI on November 16, 2009, replacing Lewis B. Freeman, who had been appointed Receiver on January 4, 2000. Managing Director of Michael Moecker & Associates, von Kahle's
duties as the Receiver are to marshal, preserve, protect,
maintain and safeguard the assets and records of PRSI. Please
understand that, as Receiver, Mr. von Kahle is an officer of the court
and neutral as to the legal dispute between the Attorney General’s
office and the defendants.
Since his appointment, the Receiver’s office has
received many phone calls from members of PRSI asking questions about their
status with the company. Since it is
difficult to respond, individually, to the thousands of people who have
questions, we have listed below the most frequently asked questions and
included the Receiver's answer to those questions.
The Receiver will continue to up-date this website as
further events unfold.
Frequently Asked Questions
1. When
will the Attorney General's lawsuit against PRSI be concluded?
The matter is still pending in the court. By agreement, the defendants have until
February 7, 2000 to file their response to the Attorney General's
Complaint. After that, if no settlement
is reached by the parties, the case will be set for trial. The Receiver cannot estimate when that will
occur. Rumors, emails, and other
communications which suggest that there has been a settlement between the
Attorney General and the Receiver or that the defendants have been exonerated
are incorrect. Please check this
website frequently for accurate and timely information.
2. How can
I get a refund of my $295.00?
PRSI’s bank account is now controlled by the
Receiver. The Receiver will not be
issuing refunds to anyone until the Court determines the future of PRSI.
3. Can I
still expect to receive my SOHO system, computer and other items promised?
Until further order of the Court, the Receiver is
marshaling and preserving the assets of PRSI.
Accordingly, the Receiver will not be providing those items to any
member at this time. Should the Court
rule that PRSI may resume its business operations, these matters will be dealt
with by the management of the company.
According to H. Dohn Williams, counsel for the defendants “It appears
that CitX is continuing to deliver SOHO systems to PRSI customers at its web
site i3x.net.”
4. If I
used my credit card to become a member of PRSI, can I get a chargeback from my
credit card company?
You have to discuss any possible chargebacks directly
with your credit card company.
5. Important
note regarding E-Mail
Please respond to item # 6 to go on record with the
Receiver. Please do not slow the
process down by sending in generic protest or comments on the actions taken by
the court. We will use the E-Mail to create a database for future updates. See below for instruction to communicate
with Receiver.
